Witness’ absence stalls widow vendor ejection suit

The absence of a witness to a widow (defendant) has stalled hearing in the suit No. MKP/RP/378/2019, filed by Prince Chidi Okolo, against a widow and newspaper vendor, Mrs Ngozika, to vacate the empty space at No. 280 Obodoukwu Road, shoe site, Okpoko, which she occupies as newspaper vendor.

When the case came up for hearing at the Ogbaru Magistrate court, in Okpoko and presided over by M. N. Aduma, counsel to the defendant, Barr. V.A. Akamonu, told the court that a witness to her client was not in court due to the death of his wife and pleaded that the case be adjourned.

Magistrate Aduma, in sympathy, consequently adjourned the case to February 4 2021.

Recall that the plaintiff dragged the defendant to court vowing to eject her for refusing to make further payment to him recently as tenant.

In her statement of defence, Ngozika said she was given the open space by the management of South East Park, Okpoko and not the defendant, adding that receipts of payment for the open space were also not issued to her by the plaintiff who, she alleged, rather demanded exorbitant extra payment for her to retain the space, a demand the defendant rejected.
